Terms of Service

1. Acceptance of Terms

By accessing or using the Edynsgate platform, website, mobile applications, or any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Services. We reserve the right to update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.

3. Account Registration & Security

To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. The Effort Exchange Program

Edynsgate operates the Effort Exchange program, which provides participants with housing, education, health, and related services in exchange for a percentage of earned income as described in your individual participation agreement. Specific terms, obligations, and benefits are outlined in the participation agreement executed at enrollment. These Terms govern general platform use; your participation agreement controls in the event of a conflict regarding program-specific terms.

5. Financial Services & Disclosures

Edynsgate may facilitate financial transactions, payment processing, income verification, and bank account linking through third-party service providers including Stripe and Plaid. By using these features, you also agree to the terms of service and privacy policies of those third-party providers.

  • Payment processing is provided by Stripe, Inc. Payments are subject to Stripe’s Services Agreement.
  • Bank account linking and income/employment verification are provided by Plaid, Inc. Use of Plaid is subject to Plaid’s End User Privacy Policy.
  • Edynsgate is not a bank, credit union, or licensed money transmitter. We do not hold deposits, extend credit, or provide investment advice.

6. SMS/Text Messaging Terms

By providing your phone number and opting in, you consent to receive SMS/text messages from Edynsgate related to your account, application status, program updates, appointment reminders, and important service notifications. Message and data rates may apply.

6.1 Message Frequency

Message frequency varies based on your account activity and program participation. You may receive up to 10 messages per month. Recurring messages will be sent for as long as you remain enrolled or until you opt out.

6.2 Opt-Out

You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message. You may also contact us at support@edynsgate.com to opt out. Opting out of SMS does not affect your program enrollment.

6.3 Help

6.4 Supported Carriers

SMS services are supported on major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.

6.5 No Mobile Information Sharing

We will not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or personal information collected through our SMS program to any third party. Consent to receive SMS messages is not a condition of purchase or enrollment.

7. E-Sign Consent

By using the Services, you consent to receive disclosures, notices, agreements, and other communications electronically. You agree that electronic signatures, contracts, and records satisfy any legal requirement that such communications be in writing.

8. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Provide false, misleading, or fraudulent information.
  • Attempt to gain unauthorized access to any part of the Services or related systems.
  • Interfere with, disrupt, or create an undue burden on the Services.
  • Use the Services to transmit spam, malware, or other harmful content.
  • Reverse engineer, decompile, or disassemble any portion of the Services.

9. Intellectual Property

All content, features, trademarks, and functionality of the Services — including text, graphics, logos, and software — are the exclusive property of Edynsgate or its licensors and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EDYNSGATE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDYNSGATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless Edynsgate and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Either party may seek injunctive relief in any court of competent jurisdiction.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
